1. Agreement to Terms
By accessing or using PM33's Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
PM33 provides an AI-powered strategic intelligence platform for product management teams, including:
- AI-driven strategy analysis and PRD generation
- Product velocity tracking and optimization
- Revenue prediction and ROI analysis
- Integration with project management tools
- Automated workflow execution ("AutoPilot")
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and have the authority to bind your organization to these Terms.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of unauthorized access
4. Subscription and Billing
4.1 Pricing Tiers
- Starter: $29/month (40 operations)
- Team: $79/month (200 operations)
- Scale: $199/month (800 operations)
- Enterprise: $599+/month (3000+ operations)
4.2 Operations
An "Operation" includes:
- Strategic analysis requests
- PRD generation or imports
- Revenue predictions
- Velocity assessments
- Integration syncs
- Report generation
- Bulk prioritization
- AutoPilot automation
4.3 Billing Terms
- Subscriptions are billed monthly or annually in advance
- Overage charges: $0.50 per additional operation
- All fees are non-refundable except as required by law
- Prices subject to change with 30 days notice
4.4 AutoPilot Add-On
Optional automation service available for additional monthly fee based on tier
5. Acceptable Use Policy
You agree NOT to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit malicious code or interfere with the Service
- Attempt to gain unauthorized access to any systems
- Use the Service to harm, threaten, or harass others
- Reverse engineer or attempt to extract source code
- Resell or redistribute the Service without authorization
- Input false or misleading data to manipulate results
- Use automated systems to abuse the Service
6. Intellectual Property
6.1 Your Content
You retain ownership of all content you submit to the Service. You grant PM33 a limited license to use, process, and display your content solely to provide the Service.
6.2 PM33 Property
The Service, including all AI models, algorithms, designs, and documentation, remains the exclusive property of PM33.
6.3 AI-Generated Content
Content generated by our AI is provided for your use within the scope of your subscription. You are responsible for reviewing and validating AI outputs.
7. Data Processing and Privacy
7.1 Data Processing
We process your data as described in our Privacy Policy and Data Processing Agreement.
7.2 AI Processing
Your data may be processed by AI services (OpenAI, Anthropic, Together AI) but is not used to train their models without explicit consent.
7.3 Integration Data
You authorize us to access and synchronize data from connected third-party tools as necessary to provide the Service.
8. Service Level Agreement
8.1 Availability
- Target uptime: 99.9% (excluding scheduled maintenance)
- Scheduled maintenance: Maximum 4 hours monthly, with 48-hour notice
8.2 Support
- Starter/Team: Email support, 48-hour response
- Scale: Priority support, 24-hour response
- Enterprise: Dedicated support, 4-hour response
9. Disclaimers and Limitations
9.1 No Warranty
The Service is provided "AS IS" without warranties of any kind. We do not guarantee that AI predictions or recommendations will be accurate or achieve specific results.
9.2 Limitation of Liability
PM33's total liability shall not exceed the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9.3 Indemnification
You agree to indemnify PM33 against claims arising from your use of the Service or violation of these Terms.
10. Termination
10.1 By You
You may cancel your subscription at any time through your account settings.
10.2 By PM33
We may suspend or terminate your account for Terms violations or non-payment.
10.3 Effect of Termination
Upon termination, your access ends immediately. You may export your data within 30 days.
11. Governing Law
These Terms are governed by Delaware law. Disputes shall be resolved through binding arbitration in Miami, Florida.
12. Changes to Terms
We may modify these Terms with 30 days notice for material changes. Continued use constitutes acceptance.
